  • It may be possible to bring a claim against a Timeshare Resort in another country.  this very much depends on the law of the land, the dates of your purchase and what paperwork you have retained.


  • Provided that you have the relevant paperwork, a breach of contract can be identified and your timeshare was contracted with a Spanish entity.   You may have a route to making a claim and recovering some of your lost money.


  • Spanish Timeshare claims can be expensive to run and Litigation Funding is often needed.


  • if you have a Spanish claim, we are able to provide you with a route to claim where litigation funding is often available to those that require it.


  • There are advantages and disadvantages of bringing a claim in Spain.   The primary issue to consider is that winning your claim in Spain does not automatically mean you will recover your money.  This very much depends on the financial liquidity of the Resort.

  • for obvious reasons, most of our clients have an overwhelming desire to stop making maintenance payments.


  • There are some points to consider before stopping these payments.


  1. Stopping will not automatically cancel your Timeshare.
  2. Stopping may affect your ability to make a claim in Spain.
  3. Stopping will not affect your ability to make the UK based s75 of s140 claim.
  4. Stopping will not affect your credit rating.
  5. Stopping may mean that you receive threats of legal action from the resort.   Usually, these threats are no more than a form of bullying in order to force you into paying!
  6. Stopping will probably create cold calls and suggested solutions from potential fraudsters pretending to be a regulated claims company.

  • Belief;    Many timeshare contracts have a Perpetuity clause; if your contract has a perpetuity clause your contract will run for a fixed period of time regardless of the owner of the timeshare.

 

  • When you die if there is time to run on your timeshare contract and the liability will pass onto your heirs.

 

  • Fact;    Perpetuity clauses are illegal and are in themselves sufficient grounds to cancel your timeshare and recover your money.

 

  • ANY ACTION MUST BE DONE BEFORE A COURT - there is no other way to guarantee that your timeshare is cancelled.


  • Be very aware of other solutions that are suggested to you!
